Terms of service.
These terms of service apply to all services provided by Kian James Photography( KJP) to the Client. By engaging the services of KJP, the Client agrees to be bound by these Terms.
Services a. KJP agrees to provide photography services to the Client as described in the agreement between the Client and KJP. b. KJP reserves the right to substitute another photographer of comparable quality in the event of photographer’s illness or emergency.
Payment a. The Client agrees to pay the Photographer’s fees in accordance with the agreement between the Client and Photographer. b. Payment is due upon receipt of the final images.
Copyright and Reproduction a. The Photographer retains the copyright to all images created under these Terms. b. The Client is granted permission to make unlimited copies of the images for personal use only. c. The Client may not sell or otherwise distribute the images without the Photographer’s written permission.
Image Usage a. The Client grants the Photographer the right to use the images for advertising, display, website promotion, and other commercial purposes. b. The Client agrees that the Photographer may use watermarked versions of the images for these purposes.
Limitation of Liability a. The Photographer shall not be liable for any damages arising from the use of the images, including any indirect, incidental, or consequential damages. b. The Photographer’s liability is limited to a refund of fees paid by the Client.
Indemnification a. The Client agrees to indemnify and hold harmless the Photographer against any claims arising from the use of the images.
Governing Law a. These Terms shall be governed by and construed in accordance with the laws of the Sate of Minnesota, and the United States of America
Entire Agreement a. These Terms constitute the entire agreement between the Client and Photographer and shall not be modified except in writing signed by both parties.
By engaging the services of Kian James Photography, the Client agrees to be bound by these Terms.
